Neighbor shot my horse because it was on his property. The officer told me that he could do that because the horse is trespassing? Does this sound right . He has my cell number and he should had call the police before he shot my horse. Why didn’t the officer charge him for cuelty to animals. What should I do.

Contact an attorney and press charges, if for nothing else cruelty to animals. Get the ASPCA involved, they will probably be more than willing to prosecute.

Sound to me like the officer might have been a member of one of the good ole boys club and didn’t want to do his paperwork.

I’d consult with an attorney, there’s no charge for that and then call the national animal control or the nearest animal shelter for assistance and info.

I’m sure you have something here, just not quite sure which charge it would be.

Good luck, and sue the lousy neighbor for damamges at least. Jackie b

I do not see the logic of a property owner who could conceive shooting the animal who could not read a no trespassing sign. A fence would have been more logical. Personally i think the shooter is wrong and hateful. Take your case to court. Have them both charged for assault against your property. The land has a better chance for survival but the horse was given less value , why is that discrimination allowed to exist.

I would fight that. He can’t shoot an animal unless it was trying to attack him or another animal.

Next time that guy steps onto your property, shoot him for trespassing.

Is it legal? It depends on the state, but I am guessing that it is. The reason for this is if you have a herd of cattle or some other animal that eats grass, it could start to eat all the grass on your neighbor’s property and then he’d be required to buy food for his herd or flock because your herd/flock would be “stealing” the grass that was on his grazing land.

Now, is it ethical? That’s another story altogether. He should have informed you of it beforehand and you should have fixed your fence, and that would be that.

As for the animal cruelty charge, the animal was in a place it shouldn’t have been, and if it was destroyed humanely, then it wouldn’t be considered cruelty.

It’s not legal in any state.
First, criminal laws such as trespassing only apply to humans. If even the horse were trespassing, it doesn’t warrant death. Can you shoot a child who wanders onto your property? Clearly not.
Secondly, the horse is considered property. If your property is on your neighbor’s yard, he has a legal right to remove it and you are liable for any damage that may have been caused by your property being on his yard, but he can not destroy your property. You have legal recourse through small claims court. You are entitled to the value of the horse.

Your question first, can a horse be shot for trespassing? ABSOLUTELY NOT. No the horse can no way be shot because of trespassing. What you should do? File a civil suit against the person who shot your horse. A monetary damages amount to the equivalent of another horse.

That officer you talk with and later told you that person could shoot your horse doesn’t know what he is talking about, either he is just out of the academy and didn’t study his lesson or he doesn’t know anything at all. He should be returned to the academy for more seminars. So what if one of your son trespass to his property, he got rights too to shoot your son because he will tell the officer he is trespassing. That is the most stupid statement I ever heard. Where is this coming from in the US? You mean there are people like this there?

Yes he should inform you about the horse trespassing to his property because he got your celphone number, he should have called you not the police. Even if he called the police he got no rights to shoot the horse now that the police is already there, what for? You should also report this to the organization for cruelty of animals regarding the incident to your horse. Let them condemn the guy who did this. And file a civil suit so that he should learn his lesson next time around.
